This module provides an outline of the “merit system”, as it applies to many classified employees in California school districts . It describes how to make the merit system work for you by explaining merit system functions related to classified employee rights, the rules and regulations governing employees working in school districts adopting the merit system . Its integration and possible conflicts with collective bargaining rights guaranteed employees and their union under the Educational Employment Relations Act (EERA).
This module, along with formal training, will clarify how the collective bargaining and merit system laws work together, and what the respective responsibilities and jurisdictions are of the unions, school boards and personnel commissions (the governing body of the merit system) in regard to scope of representation issues . How collective bargaining processes affect the Personnel Commissions authority to make rules and regulations regarding the rights and responsibilities of classified employees .
