Brexit and Procurement Law

Public procurement law, which regulates public sector purchasing of certain contracts for goods, works and services, will almost inevitably be affected by the consequences of Brexit.2,3 Domestic procurement legislation may need to be reconsidered and revised to accommodate both the nature of the UK’s changing relationship with the European Union and the UK’s developing domestic policy goals. At a time of significant uncertainty about an area of EU law which is so closely intertwined with the UK’s economy, this book explores the various policy directions which domestic procurement law could take in the future. Examples include whether ‘Buy National’ policies might feasibly be introduced, or whether existing procurement procedures could be significantly reviewed. This book investigates the possible impacts of Brexit on existing procurement legislation (for example, whether key pieces of legislation will be retained or significantly revised) and discusses the future of the legal relationship between UK public procurement legislation and EU public procurement case law. It may initially seem that the development of procurement law after Brexit is a slightly academic subject, remote from everyday life and only of interest to academics, lawyers and public procurement practitioners. However, public procurement law regulates the use of taxpayers’ money in many key areas which impact directly on daily life, from the regeneration of local areas, the construction of schools and hospitals, to the collection of waste and street cleaning. Every taxpayer has an interest in whether the tendering processes for private operators of these services are run equitably and transparently and whether value for money is achieved. Therefore, any proposed changes to the current system merit a high degree of public scrutiny
